1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you ("Client," "Customer," or "Signer") and Party Rentals Phx ("we," "us," or "our"), concerning your access to and use of our services, including but not limited to photo booth rentals, equipment rentals, and related services (collectively, "Services"). By booking our Services, you agree to comply with and be bound by these Terms.

2. Services Provided

Party Rentals Phx agrees to provide the services as outlined in your selected package, including delivery, setup, and removal of the photo booth equipment. All services provided will be detailed in a service contract, which must be signed by the Client before the event.

3. Booking and Payment

• Booking: To secure your date and time, a non-refundable deposit of 25% is required upon signing the service contract. The remaining balance is due on the day of the event after setup is completed.
• Payment Method: Payments must be made online via HoneyBook using a valid credit card. Cash or check payments are not accepted.

4. Cancellation Policy

• Cancellations are permitted up to 24 hours before the scheduled event date. The deposit is non-refundable under any circumstances.
• Cancellations made less than 24 hours before the event will result in the forfeiture of any payments made.

5. Liability

• Client Responsibility: The Client is responsible for the safety and security of all equipment from the time of delivery until it is picked up by Party Rentals Phx. Any damages or loss incurred during this period will be the Client's responsibility, and charges for repair or replacement will be billed to the Client.
• Party Rentals Phx Liability: We are not responsible for any injuries, damages, or losses that occur during the event, except in cases of gross negligence or willful misconduct by our staff.

6. Late Fees and Overtime Charges

• If the equipment is not ready for removal at the agreed-upon time, a late fee of $50 will be applied.
• If the Client is more than 30 minutes late, an overtime charge of $125 per hour will be applied after the late fee.

7. Use of Photos for Marketing

By booking our Services, the Client grants Party Rentals Phx permission to use any photos or videos taken during the event for marketing purposes, including but not limited to social media, website content, and promotional materials. If the Client does not wish to have their event photos used for marketing, they must notify Party Rentals Phx in writing before the event.

8. Force Majeure

Party Rentals Phx is not liable for any failure to perform its obligations under this Agreement due to events beyond its control, including but not limited to Acts of God, natural disasters, and government restrictions.

9. Safe Working Environment

The Client agrees to provide a safe and appropriate environment for the operation of the photo booth. If our staff deems the environment unsafe or inappropriate, Party Rentals Phx reserves the right to cancel services without a refund.

10. Equipment Care

The Client agrees to take all necessary precautions to ensure that the equipment is not damaged or lost. The Client will be liable for any costs related to the damage or loss of equipment during the rental period.

11. Intellectual Property

All content, designs, templates, and photos provided by Party Rentals Phx are protected by copyright laws. The Client may not use, reproduce, or distribute these materials without our express written permission.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the courts of [Your State].

13. Entire Agreement

These Terms, along with any service contract, constitute the entire agreement between the Client and Party Rentals Phx. No other agreements, representations, or warranties, whether oral or written, shall be deemed to bind the parties.

14. Amendments

Party Rentals Phx reserves the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting to our website or notification to the Client.
